Terms of Service

1. Acceptance of Terms

By accessing or using CFAI (Cognitive Flow AI), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

CFAI is a Windows desktop application that provides meeting transcription, AI-powered summarization, and cognitive support features. Audio transcription is performed entirely on your device. CFAI connects to external AI APIs exclusively via encrypted HTTPS to deliver chat and cognitive inference features.

3. License and Usage

CFAI offers two plans:

• Trial — free access with limited daily usage, no purchase required
• Pro — subscription-based access with monthly credits. The license is active only while the subscription remains valid.

All plans are for personal or business use and do not include the right to:

• Resell, redistribute, or sublicense the software
• Reverse engineer, decompile, or disassemble the software
• Use the software for illegal purposes
• Share your account or credentials with others

3b. Credits System

Pro plan usage is governed by a monthly credits allowance. Different AI models consume different credit amounts per request. Credits reset at the start of each billing period and unused credits do not carry over. Trial users are subject to daily usage limits. Credits are a service entitlement, not a monetary asset, and have no cash value.

4. Third-Party Services

CFAI uses the following third-party services:

• Anthropic (Claude) — AI chat and cognitive inference (Pro users), via encrypted HTTPS
• Groq — AI chat inference (Trial users), via encrypted HTTPS
• Stripe — payment processing and subscription management
• Railway / Neon — backend hosting and database infrastructure (EU region)

Your audio and transcription data is processed entirely on your device and never transmitted to external servers. AI chat prompts are transmitted to the respective inference provider over encrypted HTTPS and are not stored on our servers.

We are not responsible for any changes, interruptions, or issues with third-party services that may affect CFAI functionality.

5. Acceptable Use

You agree not to use CFAI to:

• Record conversations without proper consent from all parties
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit harmful, offensive, or illegal content
• Attempt to circumvent security measures
• Use the service in any way that could damage our reputation

6. Recording Consent

Important: You are solely responsible for ensuring you have proper consent to record any conversations or meetings. Laws regarding recording consent vary by jurisdiction. Some jurisdictions require all-party consent. We strongly recommend you familiarize yourself with applicable laws and always obtain proper consent before recording.

7. Intellectual Property

CFAI and all related intellectual property, including but not limited to software, logos, and documentation, remain the property of Cognitive Flow AI by Code Craft DS. Your subscription or use of the service grants you a license to use the software, not ownership of the intellectual property.

8. Disclaimer of Warranties

CFAI is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or meet your specific requirements. AI response quality depends on the underlying third-party inference providers.

9. Limitation of Liability

To the maximum extent permitted by law, Cognitive Flow AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid in the 3 months preceding the claim.

10. Cancellations and Refunds

Pro (subscription): You may cancel at any time; cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused periods. Under EU consumer law (Directive 2011/83/EU), you have a 14-day right of withdrawal from the date of your first subscription payment. This right lapses once the service has been fully activated at your express request.

Trial: No payment required; no refund applicable.

11. Updates and Modifications

We may update the software and these terms from time to time. Continued use of the service after changes constitutes acceptance of the modified terms. We will notify you of significant changes by email or through the application.

12. Termination

We reserve the right to terminate or suspend your access to CFAI at any time for violation of these terms. You may cancel your subscription or terminate your account at any time by contacting us at support@cfai.io.

13. EU AI Act Compliance

CFAI uses AI models for cognitive support and meeting assistance. In accordance with applicable provisions of the EU AI Act, we disclose that these systems are not used for prohibited or high-risk purposes as defined under the Act.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of the European Union and the applicable laws of Italy, without regard to conflict of law principles. EU consumers retain all statutory rights granted under applicable EU consumer protection law regardless of this clause.
